The Committee on Political Subdivision moves to amend the bill on page 1, line twenty-two, by striking everything after the enacting section and inserting in lieu thereof the following:
"ARTICLE 14. CIVIL SERVICE FOR DEPUTY SHERIFFS.
§7-14-17f. Right to receive salary increases based on education level.

A county commission may establish a tuition reimbursement program or provide a salary increase for a deputy sheriff who obtain a certain degree a follows:
(1) A deputy sheriff who attains:
(A) An Associate's Degree from an accredited college or university or through the West Virginia Board of Regents shall receive a monthly salary increase of $125.00 per month;
(B) A Bachelor's Degree from an accredited college or university or through the West Virginia Board of Regents shall receive a monthly increase of $250.00 per month; or,
(C) A Master's Degree from an accredited college or university shall receive a monthly salary increase of $375.00 per month.
(2) The increase is in excess of salary increases for rank, longevity or across-the-board pay raises. This salary increase shall take effect on July 1
following the awarding of the applicable degree.
(3) A deputy sheriff, currently possessing an applicable, salary increase becomes effective on July 1, 2010.
(4) These salary increases are not cumulative and a deputy sheriff may only receive the monthly salary increase for the highest academic rank attained.
(5) Any applicable degree must be received through a college or university accredited from an accrediting source recognized as such by all institutions of higher learning in this state.
(6) Instead of adopting the above salary increases established in subdivision (1) for a deputy sheriff having or attaining degrees of higher learning, a county commission may adopt a program where a deputy sheriff employed in the county shall receive reimbursement for all tuition expenses and expenses incurred for the purchase of textbooks while attending college-level courses at any accredited college or university, including college level courses up to and including Master's Degree level courses. If a county commission offers the tuition reimbursement program, it must offer increases in the monthly salary to a deputy sheriff equal to one-half the monthly increases offered under subdivision (1) of this section for the degree to be obtained.
(7) A county commission adopting this option may require a deputy sheriff receiving tuition and textbook expense reimbursement to enter into a contract requiring the deputy sheriff to remain employed in that county for one year following each tuition and textbook expense reimbursement.
(8) The contract shall require a deputy sheriff failing to honor his or her contract to reimburse the county commission an amount equal to twice the amount received in the tuition and textbook expense reimbursement received during the preceding year.
